Welcome to Caricature Image Converter. These Terms and Conditions ("Terms") govern your use of the Caricature mobile application and related services (the "Service") operated by Dedaldev DOO ("Company," "we," "us," or "our").

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Service Description

Caricature Image Converter is an AI-powered mobile application that transforms portrait photographs into various caricature styles. The Service offers:

Weekly, monthly, or annual auto-renewing subscriptions with a daily AI generation allowance
Pay-per-image credits for individual caricature generations
Various artistic caricature styles including classic, editorial, sports-themed, and more

3. Account Registration

To access certain features of the Service, you may need to create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain the security of your account credentials.
Promptly notify us of any unauthorized access to your account.
Accept responsibility for all activities that occur under your account.
Use your account for your own personal use only. Sharing your account, login credentials, or subscription benefits with other individuals is strictly prohibited. Each subscription is tied to a single user account and may not be used by multiple different people, whether simultaneously or at different times. Violations of this rule may result in immediate account restriction or termination, subject to our standard account policies.

4. Payments and Subscriptions

Payment Processing: Payments are processed through Apple App Store, Google Play, Stripe, or Paddle. Their respective terms and conditions also apply to your transactions.

Subscriptions: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Daily Generation Allowance: Active subscribers receive a daily allowance of AI generations depending on their plan (Yearly: 12 generations/day, Monthly: 12 generations/day, Weekly: 10 generations/day). Unused daily generations do not carry over to the next day.
Extra Generations: Subscribers who reach their daily allowance may purchase additional generations at a discounted rate. These credits are non-refundable and valid for a single use.
Cancellation: You can cancel your subscription through your device's app store settings. Cancellation takes effect at the end of the current billing period.
Credits: Pay-per-image credits are non-refundable and do not expire.
Price Changes: We reserve the right to change subscription prices. You will be notified of any price changes before they take effect.
Refunds: Refund requests are handled according to the policies of the respective app store (Apple App Store or Google Play).

5. Intellectual Property Rights

Your Content: You retain all ownership rights to the images you upload to the Service. By uploading images, you grant us a limited, non-exclusive license to process your images solely for the purpose of providing the Service.

Generated Caricatures: The caricatures generated by the Service are assigned to you, subject to any third-party rights in the source upload. You may use generated caricatures for personal and commercial purposes.

Our Content: The Service, including its design, features, AI models, and branding, is owned by the Company and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

6. Prohibited Uses

You agree NOT to use the Service to:

Upload images you do not own or have rights to use.
Create content that is illegal, defamatory, obscene, or infringes on others' rights.
Upload images of minors without parental consent.
Generate content intended to harass, bully, or harm others.
Reverse-engineer, decompile, or attempt to extract the source code of the Service.
Use automated systems or bots to access the Service.
Abuse payment systems or attempt fraudulent transactions.
Violate any applicable laws or regulations.

7. Content Moderation

We reserve the right to review, moderate, and remove any content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts that repeatedly violate our policies.

7a. Abuse Detection and Account Restrictions

We actively monitor usage patterns on our servers to detect and prevent abuse of the Service, including but not limited to excessive automated API requests, systematic circumvention of generation limits, or use of the Service through unauthorized third-party clients, automated scripts, or bots.

We reserve the right, at our sole discretion and without prior notice, to:

Classify any account as a restricted or abusive account if we determine, based on observed usage patterns, that the account is being used in violation of these Terms or in a manner that places an undue burden on our infrastructure or constitutes an attempt to circumvent payment or generation limits;
Impose generation limits, including a daily generation limit of zero (0), on any such account;
Suspend, restrict, or permanently terminate access to the Service for any account so classified, without refund of any unused credits or subscription time, except where required by applicable law.

By downloading, installing, or using the Service, you expressly acknowledge and agree that the Company may implement such technical restrictions as a measure to protect the integrity, availability, and fair use of the Service for all users. Such restrictions do not constitute a breach of these Terms or of any contractual obligation on our part.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose.
Warranties that the Service will be uninterrupted, error-free, or secure.
Warranties regarding the quality or accuracy of AI-generated caricatures.

We do not guarantee specific results from using the Service. AI-generated outputs may vary in quality and style.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages.
Loss of profits, data, or goodwill.
Any damages arising from your use or inability to use the Service.
Any content generated by the AI that may be offensive or inaccurate.

Our total liability for any claims related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

Your use of the Service.
Your violation of these Terms.
Your violation of any third-party rights.
Content you upload to the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

Your right to use the Service will immediately cease.
Any unused credits or remaining subscription time may be forfeited.
We may delete your account data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Belgrade, Serbia.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede any prior agreements.
